1. Introduction
These Terms of Use (hereinafter — "Terms") define the rules and procedure for using the Didgitalkzhelp
website, located at: www.didgitalkzhelp.online (hereinafter — "Site").
By using the Site, you accept these Terms fully and unconditionally. If you do not agree with any provision
of these Terms, you do not have the right to use the Site.
The Site Administration reserves the right at any time to change, add, or delete points of these Terms
without notifying the user. Continued use of the Site by the user implies acceptance of changes.
2. Key Terms
The following terms are used in these Terms:
- Site — the website located at: www.didgitalkzhelp.online.
- Site Administration — authorized employees acting on behalf of Didgitalkzhelp, who manage
the Site and provide Site services.
- User — any natural person who has access to the Site via the Internet and uses the Site.
- Content — any information posted on the Site, including texts, graphic images, audio and
video materials, computer programs, and other intellectual property objects.
3. Subject of the Terms
The subject of these Terms is providing the User with access to information materials and services posted on
the Site.
The Site provides the User with the following types of services (services):
- Access to information about Didgitalkzhelp services and activities;
- Possibility to use feedback services;
- Access to information materials on financial planning and achieving life goals;
- Other types of services implemented on the Site pages.
All currently existing services of the Site, as well as any subsequent modifications and additional services
appearing in the future, fall under these Terms.
4. Rights and Obligations of the Parties
4.1. The Site Administration has the right:
- To change the rules of Site use, as well as to change the Content of the Site at any time at its
discretion without prior notice to the User;
- To limit access to the Site in case of User's violation of these Terms;
- To collect, analyze, use, share information about User actions on the Site in accordance with the Privacy
Policy;
- To send information to the User about the development of the Site and its services, as well as advertise
its own activities.
4.2. The User has the right:
- To gain access to use the Site after complying with registration requirements (if any);
- To use all services available on the Site in accordance with these Terms;
- To ask questions relating to Site services through the feedback form or the contact details provided on
the Site;
- To use the Site exclusively for legal purposes and in accordance with these Terms.
4.3. The User undertakes:
- To provide accurate information about themselves during the use of Site services;
- To respect the property and non-property rights of authors and other right holders when using the Site;
- Not to take actions that could be considered as violating the normal operation of the Site;
- Not to distribute through the Site any confidential and protected by the legislation of the Republic of
Kazakhstan information about natural or legal persons;
- To avoid any actions that may violate the confidentiality of information protected by the legislation of
the Republic of Kazakhstan;
- Not to use the Site to distribute advertising information without the consent of the Site Administration;
- Not to use Site services with the aim of violating the rights of minors and (or) causing them harm in any
form;
- Not to use Site services with the aim of damaging business reputation and/or violating the legal rights of
third parties;
- Not to use the Site to propagate or agitate that incites social, racial, national, or religious hatred and
enmity, propaganda of narcotic drugs, psychotropic substances, and other prohibited materials.
4.4. The User is prohibited:
- Using any devices, programs, procedures, algorithms and methods, automatic devices or equivalent manual
processes to access, acquire, copy or track Site Content;
- Violating the proper functioning of the Site;
- Bypassing the navigational structure of the Site to obtain or attempt to obtain any information, documents
or materials by any means not specifically presented by the services of this Site;
- Unauthorized access to Site functions, any other systems or networks related to this Site, as well as to
any services offered on the Site;
- Violating the security system or authentication on the Site or in any network related to the Site;
- Performing reverse search, tracking or attempting to track any information about any other User of the
Site;
- Using the Site and its Content for any purposes prohibited by the legislation of the Republic of
Kazakhstan, as well as inciting any illegal activity or other activity that violates the rights of the Site
Administration or other persons.
5. Site Use
The Site and its Content, including all scripts, graphics, text, images, logos used here, as well as their
selection and arrangement, are the intellectual property of the Site Administration and are protected in
accordance with the legislation of the Republic of Kazakhstan on intellectual property and international
conventions.
Any use of Site materials without the written permission of the Site Administration is prohibited and
constitutes a violation of the rights of the Site Administration. Liability for violation of this provision is
provided in accordance with the legislation of the Republic of Kazakhstan.
The User is permitted to view Site materials, download Site materials to a local hard drive exclusively for
personal, non-commercial use.
The Site Administration reserves the right at any time without notifying the User to make changes to the
materials and services posted on the Site, as well as to these Terms.
6. Liability
The Site Administration is not liable for:
- Any direct or indirect losses occurring due to the use or inability to use the Site;
- Unauthorized access to User communications;
- Actions or omissions of third parties;
- Statements or conduct of any third party on the Site;
- Cessation of User access to the Site in accordance with these Terms;
- Interruptions in Site operation, including delays or failures, loss of information resulting from Site
failures, computer viruses, third-party intrusions, or any other causes beyond the reasonable control of the
Site Administration.
The User bears full responsibility for complying with the requirements of the legislation of the Republic of
Kazakhstan, including laws on advertising, on the protection of copyright and related rights, on the
protection of trademarks and service marks, but not limited to the listed, including full responsibility for
the content and form of materials provided by the User.
The User acknowledges that responsibility for any information (including, but not limited to: data files,
texts, etc.) that they may have access to as part of the Site is borne by the person who provided such
information.
7. Dispute Resolution
In case of any disagreements or disputes between the Parties to these Terms, a mandatory condition before
applying to court is the presentation of a claim (a written proposal for voluntary dispute settlement).
The recipient of the claim, within 30 calendar days from the date of its receipt, notifies the claimant in
writing of the results of the claim consideration.
If the dispute cannot be settled voluntarily, any of the Parties has the right to apply to court for
protection of their rights granted to them by the current legislation of the Republic of Kazakhstan.
Any lawsuit regarding the Terms of Use of the Site must be filed within the period after the occurrence of
the grounds for the lawsuit, with the exception of the protection of copyrights for Site materials protected
in accordance with the law. In case of violation of the terms of this point, any lawsuit or grounds for a
lawsuit are extinguished by the statute of limitations.
8. Additional Conditions
The Site Administration does not accept counter-proposals from the User regarding changes to these Terms.
User feedback and suggestions posted on the Site are not confidential information and may be used by the Site
Administration without restrictions.
These Terms are governed and interpreted in accordance with the legislation of the Republic of Kazakhstan.
Issues not regulated by these Terms are subject to resolution in accordance with the legislation of the
Republic of Kazakhstan.
9. Change of Terms
The Site Administration reserves the right to unilaterally change the terms of this Agreement. Changes come
into force from the moment they are published on the Site.
The User undertakes to regularly check the terms of this Agreement for their change and/or addition.
Continued use of the Site by the User after making changes and/or additions to this Agreement implies the
User's acceptance and consent to such changes and/or additions.
